The Entertainment Software Association (ESA) today moved to take legal action against the Chicago Transit Authority's (CTA) ban on advertisements for M-rated video games. The ban started in April 2008 when local media began questioning the prudence of posting ads for Grand Theft Auto IV in city buses, due to the game's violent content. Though the ads were reinstated in order to fulfill the terms of a settlement with Take-Two Interactive, the CTA voted to ban all advertising for M- or AO-rated video games on forms of transportation under its jurisdiction. The suit filed today by the ESA contests this ban as an attack on gaming that violates its members' rights under the First Amendment of the United States Constitution, as it targets only games that have been deemed to have mature content.
